General Terms and Conditions (GTC) of flywithfabi.de
1. scope of application
The following General Terms and Conditions (GTC) apply only to the brokerage of flights and Empty Legs by flywithfabi.de, represented by Fabian Majorcsik, sole proprietorship, e-mail: kontakt@flywithfabi.de. By using our website or utilizing our services, the customer expressly declares his agreement with these GTC.
2. arranging flights
flywithfabi.de acts exclusively as an intermediary. The contract of carriage is concluded exclusively between the customer and the respective operator, who is responsible for the execution of the flight. Our services include the search, organization and coordination of the flight as well as the representation of the customer's interests vis-à-vis the operator.
3. booking and payment
Bookings can be made via our website, by e-mail or WhatsApp.
The commission of flywithfabi.de is due with the signing of the transportation contract.
Depending on the agreement, payments for the flights can be made directly to the operator or via flywithfabi.de (including payment methods such as bank transfer or Stripe).
4 Cancellations and rebookings
Cancellations or rebookings are exclusively subject to the terms and conditions of the respective operator. flywithfabi.de is not responsible for cancellation costs or refunds, but will take care of processing and informing the customer.
5. liability
flywithfabi.de is not liable for the execution of the flight, delays, failures, damages or other events during the flight. The operator is solely responsible.
We will endeavor to find a replacement in the event of the operator's failure, but cannot guarantee this. Especially in the case of force majeure - such as short-term technical problems, weather conditions or illness - a replacement service is not always possible.
6. availability and prices
All offers for flights and Empty Legs are subject to the availability of the operator. Prices, availability and conditions are based on the information provided by the operator and may be subject to change at any time. flywithfabi.de accepts no liability for the accuracy or completeness of this information.
7. data protection
Personal data is only passed on to the operator as part of a booking. Further information on the handling of data can be found in our privacy policy.
8. use of the website
The contents of the website are for information purposes only. flywithfabi.de accepts no liability for incorrect or incomplete information.
9. special conditions
The customer undertakes to comply with the operator's general terms and conditions and conditions of carriage. Empty Legs are offered exclusively subject to the Operator's availability.
10 Choice of law and place of jurisdiction
German law shall apply. The place of jurisdiction for all disputes arising from the contractual relationship is Stuttgart.
Additional conditions for flywithfabi Club Membership
Subject matter of the contract
The flywithfabi Club Membership ("Membership") is a paid subscription that provides access to exclusive information about Jet Sharing and Empty Legs. In addition, the Membership fee paid will be deducted in full or in part from the first flight booking.
Membership, term and billing
Membership can be taken out as a monthly subscription (€49) or as an annual subscription (€499).
All prices are gross and include the applicable VAT.
The subscription begins at the end of the free trial period (5 days).
Billing is automated via the selected payment provider (Stripe).
Termination
Membership is automatically renewed unless it is terminated before expiry.
Cancellation takes place by deactivating the automatic renewal in the Stripe customer portal or by notifying us.
Membership fees already paid will not be refunded.
Offsetting the membership fee when booking a flight
Monthly subscription: maximum one monthly installment (49 €) per flight.
Annual subscription: maximum of the entire annual rate (€499), one-off on the first flight booking.
A transfer or partial crediting to several flights is not possible.
If a flight is booked within the trial period (5 days), the membership fee will be refunded retrospectively, provided the subscription was not canceled during the trial period.
Reimbursement
A refund of membership fees is excluded.
The only form of crediting is in accordance with point 4 when the first flight is booked.
If a customer cancels during an ongoing billing period, the fee remains owed and lapses after expiry.
Services
Membership grants access to exclusive information about jet sharing and empty legs.
There is no entitlement to specific flights, prices or availability.
Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days.
The right of withdrawal expires prematurely if the customer expressly agrees during the withdrawal period that the services have already begun (e.g. by using the 5-day test phase and accessing the WhatsApp group).
